Privacy Notice - Job Applicants
In this Privacy Notice (“Notice”), references to “TOMS EMEA BV”, “we”, “us” and “our” means TOMS EMEA BV. TOMS EMEA BV and its affiliated companies are referred to collectively as “TOMS”.
We know that you care about how we use your personal information and we appreciate your trust in us to do that carefully and sensibly. This Notice outlines how we collect, use and transfer (collectively “process”) your personal data.
WHO IS RESPONSIBLE FOR PROCESSING YOUR DATA?
TOMS is responsible for processing the personal data obtained from you as described in this Notice because we determine how and why your personal data is processed. See “Contacting us” below for how to contact us.
PROCESSING OF YOUR PERSONAL DATA
What categories of personal data do we collect, for what purpose and on what ground?
Any information related to a person that can be used to identify them is personal data.
We will process whatever personal data you provide to us when you apply for potential employment with us. This would typically include your contact details (e.g., complete name, postal and residential address, telephone number, e-mail address); other personal information (e.g. visa situation, date of birth, place of birth, nationality) and details of your academic record and career history. We also process the contact details of your references when we ask you to provide this information.
We will process your personal data for the purpose of evaluating your application for employment with us. Our legal ground is based on our legitimate interest to evaluate whether to offer you employment.
We will inform you separately in case your personal data will be made subject to so-called automated decision-making.
Where does TOMS obtain my personal data from?
We obtain your personal data when you apply through the online application tool used in the TOMS Careers website (https://www.toms.com/jobs)
DOES TOMS SHARE PERSONAL DATA WITH OTHERS?
We share your personal data as described below.
Our Group Companies
Only TOMS employees who are involved in the recruitment process have access to your personal data. It may also be necessary to share the personal data of applicants for certain positions with employees of TOMS in the US, Germany, and UK as part of our recruitment process. Access rights of these employees are limited and granted only on a need to know basis, depending on their job functions and roles.
Service Providers and Other Third Parties
We use third party service providers for our online application tool and to assist us in our recruitment processes and working visa requirements. To the extent that such third parties are data processors, they are contractually bound by TOMS to only process data in accordance with TOMS’s instructions and applicable legal requirements.
In certain circumstances, we share and/or are obliged to share your personal data with third parties outside TOMS, for the purpose described above and in accordance with the data protection laws. These parties will act as controllers of your personal data in their own right, and themselves will be responsible for compliance with applicable data protection laws. These third parties include administrative authorities (tax or social security authorities) and external advisors (such as legal advisors, accountants).
DOES TOMS TRANSFER PERSONAL DATA TO COUNTRIES OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)?
Aside from transferring some of your personal data to TOMS Shoes UK and TOMS GmbH and to other employees of the TOMS Group (see Our Group Companies above), we also transfer the personal data we process to countries outside the European Economic Area (“EEA”, which means all the EU countries plus Iceland, Liechtenstein and Norway), for example, when our service providers use staff or equipment based outside the EEA.
All transfers of personal data to TOMS employees or third parties located outside the EEA will be made subject to a legally approved adequacy mechanism like EU Model Clauses or the data importer will be certified pursuant to the EU-US Privacy Shield Treaty.
HOW LONG DOES TOMS STORE MY PERSONAL DATA?
If your application does not result in employment with us, we will delete your personal data upon conclusion of the recruitment process for the position you have applied for, unless you request us to keep your application for other employment opportunities. We will keep your personal data for this purpose for one year, but only if you have consented to do so.
You have the right to request an overview of your personal data processed by TOMS, object to or restrict its processing and request removal or correction if your data appears incorrect or irrelevant, by making a request to us through our data subject access request portal.
